IMSML Website Article 32/2023: MSN 04/2023 - Issuance of Blue Card Certificate for International Convention CLC 1992, BCC 2001 and WRC 2007, as well as Updated List of P7I Clubs and Insurance Service Provider Companies Recognised by Malaysia Marine Department
Today’s article is on Malaysian Shipping Notice, MSN 04/2023. The purpose of this notice is to publish several bodies, ie Protection and Indemnity (P&I) Clubs, for issuance of Insurance Certificates (Blue Cards) recognised by Malaysia’s Marine Department for the purposes of a number of international shipping conventions. These conventions include:
[1] International Convention on Civil Liability for Oil Pollution Damage 1992 (CLC 1992);
[2] International Convention on Civil Liability for Bunker Oil Pollution Damage 2001 (BCC 2001);
[3] Nairobi International Convention on the Removal of Wreck 2007 (WRC2007).
Note: MSN 04/2023 revokes MSN 05/2020.
Explanation in Annex 1
CLC 1992
CLC 1992 governs oil pollution from persistent oil from tankers. It does not extend to floating storage such as Floating Storage and Offloading (FSO), Floating Production Storage and Offloading (FPSO) and Floating Storage Unit (FSU). Maximum liability for one oil spill are provided for by CLC 1992, if a ship carries more than 2,000 tons of oil cargo. Shipowners are therefore required to maintain insurance to other financial security for this incident.
BCC 2001
Any pollution damage caused by any bunker oil on board or originating from the ship falls under the BCC 2001. For all ships exceeding 1,000 gross registered tons, BCC 2001 requires such ships to have insurance or other financial security sufficient issued by the insurance companies recognised by the Member States to cover the maximum liability for the spill.
WRC 2007
WRC requires ships measuring 300GT and above entering or leaving a port in Malaysia or any part of Malaysian waters shall maintain in respect of that ship a contract of insurance or other financial security, such as a guarantee of a bank or similar institution, to cover liability under this Convention.
